Terms of Service

1. Acceptance

By creating an account or using https://ducted.app, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. Description of service

Ducted provides the following services:

• Feed management platform - a self-serve tool to import product data from supplier feed URLs, CSV files, website scrapers, and REST APIs; transform and map fields; and publish live feed URLs for advertising platforms (Google Shopping, Meta Catalog, VLA, and custom formats). Features available depend on your subscription plan (Free, Starter, or Pro).
• Scraper setup service - a professional, quote-based service where we build a custom data scraper tailored to your source. This is a one-time service; pricing is agreed in advance and confirmed before any work begins.
• Scraper maintenance - an optional monthly subscription per scraper covering reconfiguration when the source site changes structure and notification when issues are detected.

3. Account registration

You must provide accurate information when creating an account. One account per person or organisation. You are responsible for maintaining the confidentiality of your credentials. You must be at least 18 years old to use the service.

4. Acceptable use

You agree not to:

• Scrape websites in violation of their terms of service or applicable law.
• Request scraper setup for sources you do not have the right to access or collect data from.
• Use the service for illegal purposes or to distribute harmful content.
• Attempt to circumvent rate limits, access controls, or security measures.
• Resell or sublicense the service without written permission.
• Upload malicious code or interfere with other users.

When using the scraper setup service, you confirm that you have the right to collect data from the requested source and that doing so complies with the source site's terms and applicable law. Ducted is not responsible for the legality of data collected at your direction.

5. Subscription and billing

Platform subscriptions (Starter, Pro) are billed monthly in advance. You authorise us to charge your payment method at each renewal. Cancellation stops future charges but does not entitle you to a refund for the current billing period, except where required by law.

Scraper setup fees are one-time charges. A quote is provided and accepted before any work begins; payment is due upon delivery. Scraper setup fees are non-refundable once delivery has been accepted. We provide a 30-day correction period after delivery: if the scraper fails to extract the agreed data due to a fault in our implementation, we will fix it at no additional cost.

Scraper maintenance is billed monthly per scraper and can be cancelled at any time. Cancellation takes effect at the end of the current billing month.

6. Data and content

You retain ownership of your data and configurations. You grant Ducted a limited licence to store and process your data solely to provide the service. We do not share or sell your data.

7. Limitation of liability

The service is provided "as is". Ducted is not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

8. Modifications

We may update these terms from time to time. We will notify you by email or via the platform. Continued use after the effective date constitutes acceptance of the updated terms.

9. Governing law

These terms are governed by the laws of the jurisdiction where Ducted is registered, without regard to conflict of law provisions.
